Authorized by Ordinance 2007-534 and Executive Order1-7, the City Contractors’ Pay or Play Program was established for two purposes:

1) To create a level playing field among competing contractors (so those who provide health benefits to their employees are not disadvantaged in the bidding process);

2) To recognize and account for the fact that there are costs associated with the health care of the uninsured.

Program Requirements:

 

sbdgCovered Contracts: Contracts covered by the program are those that are advertised after July 1, 2007, which are valued at or above $100,000 and are not primarily for the procurement of property, goods, supplies or equipment.

Covered Employees: This program applies to employees of a covered contractor or subcontractor, including contract labor:

  • Who are over age 18;
  • Work at least 30 hours per week ;
  • Work any amount of time under a covered city contract or subcontract

Program Compliance – The contractor has three (3) options for compliance with the program:

  1. Pay” Option – The contractor chooses to contribute $1.00 per covered employee per hour for work performed under the contract with the City;
  2. Play” Option– The contractor chooses to offer health benefits to covered employees. Health benefits must meet or exceed the following guidelines:
    1. a. The employer will contribute no less than $150 per covered employee per month toward the total monthly premium cost.
    2. b. The employee contribution, if any amount, will be no greater than 50% of the total monthly premium cost.
  3. Pay & Play” Option – The contractor chooses to comply by “Paying” on behalf of some covered employees and “Playing” on behalf of other covered employees.
  4. Subcontracts – The prime contractor is responsible for compliance on behalf of covered employees, including contract labor, of subcontractors with subcontracts valued at or greater than $200,000, if the subcontract is not primarily for the procurement of property, goods, supplies or equipment.

POP-1

POP Acknowledgment Form

Acknowledges your awareness of the program.

 

This form should be included in the bid documents of all potential contract bidders.

Certificate of compliance with POP Program

List of Participating Contractors
All subcontractors expected to be utilized during the contract should be listed on this form.
POP-4
Contractor/Subcontractor Waiver Request
Allows a contractor/subcontractor to be exempt from the POP Program should the contract meet the given criteria. This form must be requested by the contracting department on behalf of the contractor and is subject to approval.
POP-5
Contractor/Subcontractor Reporting Form (PAY)
For contractors who opt to "Pay" for any or all employees who work any amount of time on the City contract. Exempt employees (see POP-8) will be listed on this form as well. This form should be submitted monthly from the start date of the contract. Contractors are only required to "Pay" for those employees who work 30 hrs. or more per week for their firm, and any amount of time on the City contract.

Employee Health

Benefits Form

For contractors who opt to "Play" (provide health benefits) to any or all employees who work any amount of time on the City contract. This form should be submitted quarterly and should always be accompanied by proof of insurance (i.e. paid invoice listing covered employees).

Employee Waiver

Request

Provides an exemption for employees that are offered health benefits but refuse the offer. This form must be completed in its entirety and notarized by a notary public.
